Terms of Use

Store Use & Purchase Agreement

Welcome to Vcluoerni™.

These Store Use & Purchase Terms explain the conditions that apply when you browse our website, create an account, purchase stationery or craft products, submit content, or otherwise interact with the Vcluoerni™ online store.

In these Terms:

  • “Vcluoerni™,” “we,” “us,” and “our” refer to Erin Condren Designs Inc.

  • “Website” refers to the Vcluoerni™ online store and its associated pages.

  • “Services” includes the Website, products, checkout functions, customer-support features, content, and other store-related services.

  • “You” and “your” refer to the customer, visitor, account holder, or other person using the Services.

By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Notice, Shipping Policy, Return and Refund Policy, and other policies displayed on the Website.

If you do not agree, please discontinue use of the Services.

1. Eligibility to Use the Store

You must be legally capable of entering into a binding agreement in your place of residence to place an order independently.

If you are under the applicable age of majority, you may use the Website only with the involvement and authorization of a parent or legal guardian.

By using the Services, you represent that:

  • Information you provide is accurate and current

  • You are using the Website for lawful purposes

  • You have authority to use the selected payment method

  • You will comply with these Terms and applicable law

  • Any minor using a product will receive appropriate adult supervision

Some craft products may include small pieces, sharp tools, heated equipment, adhesives, cords, needles, cutting surfaces, or other components requiring careful handling. Product instructions and age guidance should always be reviewed before use.

2. Customer Accounts

An account may be offered for conveniences such as viewing orders, saving information, or managing preferences.

You are responsible for:

  • Keeping your login credentials confidential

  • Using a secure and unique password

  • Restricting unauthorized access to your device

  • Reviewing activity conducted through your account

  • Informing us promptly of suspected unauthorized access

You may not sell, transfer, rent, or assign an account to another person.

We may require password resets, identity verification, or other reasonable security measures when suspicious account activity is detected.

3. Product Information

We aim to present stationery, art tools, craft kits, storage products, and related supplies as clearly and accurately as reasonably possible.

Product pages may include:

  • Photographs and illustrations

  • Dimensions and quantities

  • Color names

  • Material descriptions

  • Included components

  • Suggested project applications

  • Care or safety information

Despite reasonable efforts, minor variations may occur.

For example:

  • Screen settings may affect how colors appear

  • Natural wood, cotton, paper, stone, or handmade-style materials may vary slightly

  • Packaging may be updated without changing the essential product

  • Measurements may be subject to reasonable manufacturing tolerances

  • Product arrangements shown in lifestyle images may include decorative props not supplied with the item

The written package-contents section on the applicable product page determines what is included unless otherwise expressly stated.

4. Craft Use and Safety

Vcluoerni™ products are intended for ordinary stationery, decorative, organizational, artistic, and hobby-related use.

Customers are responsible for:

  • Reading product instructions before use

  • Following recommended preparation and care guidance

  • Using tools only for their intended purpose

  • Keeping small components away from young children

  • Supervising minors when appropriate

  • Using heated, pointed, sharp, or cutting tools with care

  • Confirming compatibility before applying paint, adhesive, ink, or other materials to a surface

  • Testing products on an inconspicuous area when appropriate

  • Following ventilation, baking, electrical, and temperature instructions

A product description is not professional safety, medical, educational, engineering, or occupational advice.

Results may vary according to technique, surface preparation, materials, environment, and user experience.

5. Availability and Collection Changes

Products are offered subject to availability.

We may, where reasonably necessary:

  • Introduce or discontinue products

  • Adjust colors, sets, packaging, or specifications

  • Limit quantities per customer or order

  • Correct inventory information

  • Temporarily pause sales

  • Restrict delivery to certain locations

Placing a product in a cart does not reserve inventory.

If an item becomes unavailable after an order is submitted, we may contact you to offer an available alternative, cancel the affected item, or issue an appropriate refund.

6. Placing an Order

Submitting an order is an offer to purchase the selected products under these Terms.

An automated order acknowledgment confirms that we received the submission. It does not necessarily mean the order has been finally accepted or entered fulfillment.

An order is generally accepted when we:

  • Confirm payment authorization

  • Complete any necessary order review

  • Begin fulfillment; or

  • Send a shipment confirmation

Please review product selections, quantities, personalization details, delivery information, and payment information before submitting an order.

7. Reasons an Order May Be Declined or Canceled

We may decline, limit, hold, or cancel an order when reasonably necessary, including when:

  • A product is unavailable

  • Pricing or product information contains a material error

  • Payment cannot be authorized

  • Billing or shipping information cannot be verified

  • The order appears fraudulent or unauthorized

  • The quantity suggests unauthorized resale

  • Delivery is unavailable to the selected location

  • A legal, safety, sanctions, or regulatory restriction applies

  • Website misuse or policy abuse is suspected

When payment has already been captured for a canceled item, the applicable amount will be returned to the original payment method.

We will not cancel an order for an unlawful discriminatory reason.

8. Personalization Details

Where personalized or customized products are offered, you are responsible for reviewing all submitted information before completing checkout.

This may include:

  • Names

  • Initials

  • Dates

  • Short messages

  • Color selections

  • Layout choices

  • Product dimensions

  • Quantities

We may refuse personalization that is unlawful, threatening, abusive, deceptive, infringing, or otherwise inappropriate for production.

Once customization has begun, an order may no longer be changeable or cancelable.

Minor positioning, spacing, color, and production variations may occur unless the product materially differs from the confirmed customization.

9. Personal Use and Resale

Products are generally sold for personal, household, educational, creative, or ordinary small-project use.

Unless we authorize otherwise, customers may not:

  • Purchase products for deceptive or unauthorized resale

  • Remove or replace product branding to misrepresent product origin

  • Copy Vcluoerni™ packaging or presentation

  • Represent themselves as an authorized Vcluoerni™ distributor

  • Use our trademarks to promote unrelated products

Using craft supplies to create an original finished handmade project does not, by itself, make the customer an authorized representative of Vcluoerni™.

10. Prices and Displayed Charges

Product prices are shown in United States Dollars unless another currency is clearly displayed.

The amount presented during checkout may include, as applicable:

  • Product price

  • Shipping charges

  • Sales or similar taxes

  • Promotional adjustments

  • Optional services selected by the customer

  • International duties or taxes when expressly collected in advance

Before submitting payment, customers will have an opportunity to review the order total.

Customs duties, import taxes, brokerage charges, and government assessments may be collected separately by authorities or delivery providers when they are not included at checkout.

Prices may change for future purchases. A later price change does not normally alter an order already accepted.

11. Promotions and Discount Codes

Promotions may be governed by separate terms displayed with the offer.

Unless otherwise stated:

  • Promotional codes cannot be exchanged for cash

  • Only one code may be accepted per order

  • Codes must be entered before checkout is completed

  • Expired codes cannot be applied retroactively

  • Offers may be limited by product, destination, quantity, or customer

  • Discounts may not apply to shipping, taxes, duties, or excluded products

  • Promotional availability may end at the stated time

We may correct or cancel a promotion affected by a technical error, unauthorized distribution, manipulation, or fraud.

When a refund involves a bundle, free item, or purchase-threshold offer, the refund may be recalculated according to the terms of that promotion.

12. Payment Authorization

Available payment methods are displayed during checkout.

Payments are handled through third-party payment providers. Vcluoerni™ does not directly store complete payment-card numbers or card security codes on its store systems.

By submitting payment information, you represent that:

  • You are authorized to use the payment method

  • The billing information is accurate

  • The payment provider may authorize the transaction

  • Applicable order charges may be collected

A temporary authorization may appear before a payment is fully captured. Banks and payment providers control the timing of authorization releases and account postings.

We may request reasonable verification before fulfilling a transaction that triggers a security review.

13. Taxes and International Charges

Applicable taxes may be calculated according to the order details and legal requirements.

For international orders, the customer may also be responsible for:

  • Import duties

  • Value-added tax

  • Goods and services tax

  • Brokerage fees

  • Customs processing charges

  • Other local assessments

These charges may be payable directly to a carrier or government authority.

Customers are responsible for reviewing local import rules before ordering. We cannot guarantee that every product may lawfully be imported into every destination.

14. Shipping and Order Delays

Processing times, estimated delivery ranges, tracking procedures, customs information, and address responsibilities are described in our Shipping Policy.

Delivery dates are estimates unless expressly guaranteed.

If we learn that an order cannot be shipped within the time stated at purchase, we will provide the notice and options required by applicable law. Depending on the circumstances, this may include an updated estimate and an opportunity to agree to the delay or cancel the unshipped portion for a refund.

A carrier delay occurring after dispatch does not automatically mean that a shipment is lost. Customers may be asked to cooperate with a reasonable carrier investigation.

Nothing in these Terms transfers shipping risk in a manner prohibited by applicable consumer law.

15. Returns, Refunds and Order Problems

Returns, damaged-item reports, exchanges, and refunds are governed by our Return and Refund Policy.

Eligibility may depend on factors such as:

  • Time elapsed after delivery

  • Product condition

  • Whether the product has been opened or used

  • Whether materials have been cut, mixed, marked, baked, or altered

  • Whether all kit components are present

  • Whether the product was personalized

  • Whether an exception is required by law

Customers must obtain return authorization before mailing a product.

The voluntary return policy does not limit legal remedies that cannot be excluded for damaged, defective, misdescribed, unsafe, or nonconforming products.

16. Website Content

The Website may contain:

  • Product descriptions

  • Photography

  • Illustrations

  • Project ideas

  • Tutorials

  • Guides

  • Layouts

  • Videos

  • Reviews

  • Customer-support information

  • Promotional content

Content is provided for general shopping and informational purposes. We may update or remove Website content as products, practices, or availability change.

We do not guarantee that every page will always be complete, current, or free from typographical or technical errors.

17. Intellectual Property

The Website and its original content are owned by or licensed to Erin Condren Designs Inc. and are protected by applicable intellectual property laws.

Protected materials may include:

  • The Vcluoerni™ name and wordmark

  • Logos and brand elements

  • Product photography

  • Packaging artwork

  • Website layouts

  • Written descriptions

  • Graphics and illustrations

  • Videos and creative content

  • Original downloadable materials

You may view the Website and print or save limited content for personal, noncommercial shopping purposes.

Without prior written permission, you may not:

  • Reproduce substantial Website content

  • Republish product photographs

  • Copy product descriptions for another store

  • Create confusingly similar branding

  • Use our trademarks in advertising

  • Sell or sublicense Website materials

  • Remove copyright, trademark, or attribution notices

  • Use automated systems to build a competing product catalog

No ownership interest is transferred by use of the Website.

18. Customer Reviews and Submitted Content

Where reviews, photographs, comments, or other submissions are accepted, you retain ownership of your original content.

By voluntarily submitting content for publication, you grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and use it in connection with operating and promoting the store, subject to applicable privacy law.

You confirm that submitted content:

  • Is truthful to the best of your knowledge

  • Is based on a genuine experience when presented as a review

  • Does not violate another person’s intellectual property

  • Does not unlawfully disclose personal information

  • Is not defamatory, threatening, obscene, or abusive

  • Does not contain malware, spam, or deceptive links

  • Does not falsely claim sponsorship or compensation

We may moderate or remove content that violates these standards, but we are not required to publish every submission.

19. Suggestions and Product Ideas

You may voluntarily send suggestions or general feedback.

Unless a separate written agreement states otherwise, submitting unsolicited feedback does not create a confidential, employment, partnership, or compensation relationship.

We may use general suggestions to improve products or services, provided that doing so does not unlawfully use your protected personal information or infringe enforceable third-party rights.

Do not submit confidential designs, trade secrets, or proprietary product concepts without an appropriate written agreement.

20. Acceptable Website Use

You agree not to use the Services to:

  • Violate applicable law

  • Commit or facilitate fraud

  • Infringe intellectual property or privacy rights

  • Submit false order or account information

  • Interfere with checkout, payment, or inventory systems

  • Circumvent purchase limits

  • Introduce malware or harmful code

  • Test system vulnerabilities without authorization

  • Scrape or harvest information through unauthorized automated methods

  • Send spam, phishing messages, or deceptive communications

  • Impersonate another person or organization

  • Harass customers, employees, or other users

  • Manipulate reviews or promotional programs

  • Use the Website in a way that disrupts its availability or security

We may investigate suspected misuse and take proportionate action.

21. Suspension and Termination

We may restrict or terminate access to an account or Website feature when reasonably necessary to:

  • Protect Website security

  • Prevent fraud

  • Respond to unlawful activity

  • Enforce these Terms

  • Protect customers or third parties

  • Comply with a legal requirement

Where appropriate, we may provide notice or an opportunity to correct the issue.

Termination does not eliminate payment obligations, intellectual-property restrictions, liabilities, or other provisions that by their nature continue after access ends.

22. Third-Party Services and Links

The Website may interact with independently operated services such as:

  • Payment providers

  • Delivery carriers

  • Social media platforms

  • Analytics providers

  • Advertising services

  • Customer-support tools

  • Embedded content providers

Third parties operate under their own terms and privacy practices.

A link or technical integration does not necessarily mean that we endorse every statement, product, or service offered by that third party.

We are not responsible for independently operated websites outside our reasonable control.

23. Website Availability

We aim to keep the Website accessible and functional, but uninterrupted operation cannot be guaranteed.

Access may be affected by:

  • Maintenance

  • Software updates

  • Hosting interruptions

  • Network failures

  • Security incidents

  • Third-party service outages

  • Events outside our reasonable control

We may modify, suspend, or discontinue nonessential Website features when reasonably necessary.

24. Disclaimers

To the maximum extent permitted by law, the Website and informational content are provided on an “as available” basis.

We do not warrant that:

  • The Website will always be uninterrupted

  • Every technical error will be corrected immediately

  • Website content will meet every individual creative purpose

  • A particular craft result will be achieved

  • Every product will remain continuously available

  • Third-party links or services will be error-free

Product warranties, if any, will be stated on the applicable product page or included with the product.

Nothing in these Terms excludes an express promise made to a customer or a warranty, guarantee, or consumer remedy that cannot legally be excluded.

25. Limitation of Liability

To the maximum extent permitted by applicable law, Erin Condren Designs Inc. and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, or consequential losses arising solely from use of the Services.

This limitation does not apply where liability cannot legally be excluded or limited, including where applicable law protects claims involving:

  • Fraud or fraudulent misrepresentation

  • Willful misconduct

  • Gross negligence

  • Personal injury caused by legally actionable conduct

  • Mandatory product liability

  • Nonwaivable consumer rights

  • Other liability that applicable law prohibits us from excluding

Where liability may lawfully be limited, any limitation will be applied only to the extent reasonable and permitted under the circumstances.

26. Responsibility for Misuse

To the extent permitted by law, you are responsible for claims or losses caused by your intentional unlawful use of the Services, infringement of third-party rights, fraudulent activity, or material violation of these Terms.

This provision does not require a consumer to compensate us for losses caused by our own unlawful conduct, negligence, defective products, or breach of a nonwaivable legal duty.

27. Events Outside Reasonable Control

Neither party will be responsible for a delay caused by events outside its reasonable control, such as:

  • Natural disasters

  • Severe weather

  • Transportation disruption

  • Labor interruption

  • Government action

  • Customs restrictions

  • Widespread utility or network failure

  • Public-health emergencies

  • Civil unrest or armed conflict

This section does not remove obligations that remain mandatory under applicable law, including obligations concerning delayed or unfulfilled orders.

28. Governing Law

These Terms are governed by the laws of the State of California, without regard to rules that would require the application of another jurisdiction’s law.

However, this choice of law does not deprive a consumer of mandatory protections available under the law of their ordinary place of residence.

Before filing a formal claim, the parties are encouraged to contact one another and make a reasonable effort to resolve the matter informally.

Subject to applicable law, disputes that cannot be resolved informally may be brought before a court with lawful jurisdiction in Los Angeles County, California.

Nothing in this section prevents a customer from bringing a claim in another court when applicable consumer law grants that right.

29. Severability

If a court determines that part of these Terms is unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.

The remaining provisions will continue to apply where legally possible.

30. No Waiver

A delay or failure to enforce a provision does not permanently waive the right to enforce it later.

A waiver is effective only for the specific matter to which it applies.

31. Transfer of Rights

You may not transfer your contractual rights or obligations under these Terms without our written consent.

We may transfer rights or obligations as part of a legitimate merger, acquisition, restructuring, financing, asset transfer, or service reorganization, provided that the transfer does not unlawfully reduce customer rights.

32. Relationship of the Parties

Use of the Services does not create an employment, agency, partnership, franchise, joint venture, or fiduciary relationship between you and Vcluoerni™.

33. Complete Agreement

These Terms, together with the policies incorporated by reference, form the agreement governing use of the Services and purchases made through the Website.

If a product-specific written term conflicts with a general provision, the more specific term will control for that product to the extent permitted by law.

34. Updates to These Terms

We may revise these Terms to reflect changes in:

  • Store operations

  • Products or services

  • Technology

  • Security requirements

  • Payment or fulfillment providers

  • Legal obligations

The revised version will be posted with an updated effective date.

Material changes will apply prospectively unless applicable law permits otherwise. Continued use of the Services after an update constitutes acceptance of the revised Terms for future interactions.

Changes will not retroactively remove rights already acquired under an accepted order.
